ProjectionLab LLC (“ProjectionLab,” “we,” “our,” and/or “us”) values the privacy of individuals who use our application, our websites, and related services (collectively, our “Services”). This privacy policy (“Privacy Policy”) explains how we collect, use, and share information relating to the users of our Services. By using our Services, you agree to the collection, use, disclosure, and procedures described in this Privacy Policy. Beyond this Privacy Policy, your use of our application is subject to our Terms of Service.

1. Information We Collect About You

Information that we collect from or about you includes information you provide when you access our website and/or when you engage with our Services. We may also obtain information about you from trusted third party sources, including business partners, event sponsors, security and fraud detection services, social media platforms, and publicly available sources. We will only collect personal information that is adequate, relevant and limited to what is necessary in relation to the purposes identified in this Privacy Policy.

2. Purpose For Which We Hold Your Information

The main purposes for which we use your personal information are to provide, maintain, improve and update our Services.

2.1 Change of Use. We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us at the contact details listed in Section 15.

If we need to use your personal information for an unrelated purpose we will notify you and we will explain the legal basis which allows us to do so. Please note that we may process your personal information without your knowledge or consent, in compliance with this Privacy Policy, where this is required or permitted by law.

2.2 Consequences of not Providing Information. Please note that if you decide not to provide us with certain personal information, you may not be able to access or use certain features of the Services.

3. Sharing Your Information with Third Parties

There are various circumstances where we may disclose your personal information to third parties. We will make your personal information available to third parties with whom we have a relationship to provide services on our behalf. We will only provide to those third parties the personal information that is necessary for them to perform the services and where there is a lawful basis to do so.

We may share relevant personal information with the following categories of third parties:

Affiliates: with our affiliates and subsidiaries for the purposes described in this Privacy Policy.

Service Providers: with our service providers who assist us in providing the Services, such as billing, payment card processing, customer support, sales and marketing, and data analysis, subject to appropriate contractual prohibitions on their use of your personal information. We also disclose personal information to service providers who assist us with detecting and preventing fraud, security threats or other illegal or malicious behavior.

Third-Party Partners and Sponsors: with third party business partners who are involved in providing content, products or services to our prospects or customers. We may also engage with third party partners who are working with us to organize or sponsor an event to which you have registered to enable them to contact you about the event or their services (but only where we have a lawful basis to do so, such as your consent where required by applicable law).

Online Advertising Partners: with online advertising providers that tailor online ads to your interests based on information they collect about your online activity over time and across different services (known as targeting online advertising).

Sponsoring Organizations: with the organization that is sponsoring a program (e.g., promotions, sweepstakes, social media integrations).

For legal purposes: when authorized by law or we deem necessary in good faith to comply with legal process; when required to protect and defend the rights or property of ProjectionLab or our customers, including the security of our websites, products, and services; or when necessary to protect the personal safety, property, or other rights of the public, ProjectionLab, or our customers.

With your consent: when you instruct us to do so or where you have consented to the disclosure of your personal information with third parties.

Business Transactions: we may engage in transactions with other companies involving the sale of assets or parts of our business. We may disclose your personal information as part of, or in contemplation of, such transactions. If a portion of or all of our assets are transferred to a third party in connection with such transactions, your personal information may be among the transferred assets, including in the course of activities leading up to such transactions.

4. International Transfers of Data

Our Services are operated in the United States. If you choose to use the Services from other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your information outside of those regions to the United States for storage and processing. Also, we may transfer your information from the U.S. to other countries or regions in connection with the storage and processing of such information, fulfilling your requests, and operating the Services. By providing any information, including personal information, on or to the Services, you consent to such transfer, storage, and processing.

5. Data Subject Rights

Depending on your state or country of residence, you may have the following rights regarding your personal information under applicable international and U.S. state privacy laws. You can send us a request in relation to any of the rights outlined below. We will respond within 30 calendar days of receiving your request. If we need additional time, we will notify you within the initial 30-day period and may extend our response by up to the times permitted under applicable law.

5.1 Right to Know / Access. You have the right to know what personal information we hold on you, why we hold it, and how we are using it. Requests may include: (1) the categories of personal information we have collected about you; (2) the categories of sources; (3) the business or commercial purposes for collecting, selling, or sharing it; (4) the categories of third parties with whom we share it; and (5) the specific pieces of personal information we hold.

When submitting a request, please provide us with as much information as possible to help us identify the information you wish to access.

5.2 Right to Rectification / Correction. You have a right to request that the personal information held in relation to you is up to date and accurate.

Where personal information is inaccurate or incomplete, we encourage you to contact us to have this information rectified. Upon receipt of your request, we will ensure that the personal information is rectified and as up to date as is reasonably possible.

5.3 Right to Deletion. You may request that we delete personal information we have collected, subject to certain exceptions. We may deny your request if retaining the personal information is necessary for us or our service providers to:

• Complete the transaction for which we collected the personal information or provide a service that you requested.
• Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
• Debug products to identify and repair errors that impair existing intended functionality.
• Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
• Comply with a legal obligation or enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us.

5.4 Right to Opt-Out of Sale or Sharing. You have the right to opt out of the sale or sharing of your personal information, including its use for targeted advertising purposes. To exercise this right, see Section 9 below or submit a request to privacy@projectionlab.com. We will process your request as soon as reasonably practicable, but no later than 15 business days from the date of receipt.

5.5 Right to Data Portability. Where required by applicable law, you have the right to receive the personal information you have provided to us in a structured, commonly used, machine-readable format and, where technically feasible, to request that we transmit that personal information to another organization. We will refuse such a request if it would adversely affect the rights and freedoms of others.

5.6 Right Relating to Automated Decision-Making. We do not currently make decisions about you solely through automated processing that produce legal or similarly significant effects. If we implement such processing in the future, we will update this Privacy Policy and provide you with the opportunity to opt out to the extent required by applicable law.

5.7 Right to Withdraw Consent. Where we are processing your personal information on the legal basis of consent, you are entitled to withdraw your consent and opt-out of the processing of your personal information at any time. Withdrawal of consent does not affect the lawfulness of any processing we conducted prior to withdrawal.

5.8 Right to Complain. If you are not satisfied with our response to a privacy request, please contact us at privacy@projectionlab.com to request an internal review. You will not be discriminated against for exercising any privacy rights.

5.9 Right to Limit Use of Sensitive Personal Information (California Residents). If we collect sensitive personal information (as defined under the CPRA), California residents have the right to direct us to limit our use and disclosure of such sensitive personal information to uses that are necessary to perform the Services or as otherwise permitted by law. 5.10 Right to Non-Discrimination. We will not discriminate against you for exercising any of your privacy rights. We will not deny you goods or services, charge you different prices or rates, provide a different level or quality of goods or services, or suggest that you may receive a different price or quality of goods or services because you exercised your rights.

6. How to Exercise Your Rights

If you (or an authorized agent acting on your behalf) wish to exercise any of your rights under applicable data privacy laws, submit a request online by emailing us at privacy@projectionlab.com. We will respond to requests that we receive in accordance with applicable laws. We may take certain steps to verify your request using information available to us, such as your email address or other information associated with your ProjectionLab account, and if needed we may ask you to provide additional information for the purpose of verification. Any information you provide to us for verification purposes will only be used to process and maintain a record of your request.

Depending on the laws applicable to your request, if you are not satisfied with our response to your request, you may have the ability to appeal our response. If an appeal right is applicable to you, we will let you know in our response to you.

7. Marketing

We may periodically send you marketing communications that promote our products and services consistent with your choices. You may opt out from receiving such communications by following the unsubscribe instructions in the communication you receive.

8. Cookies and Tracking Technologies

We use cookies and similar tracking technologies on our website. Cookies are small text files placed on your device that help us recognize you, remember your preferences, analyze usage, and deliver targeted advertising. Cookies may collect information such as your IP address, browser type, device information, pages visited, and interactions with our website. You can manage your preferences via our Cookie Consent Manager, accessible on our website; however, disabling cookies may limit certain features of the website.

9. Notice of Right to Opt Out of Data Sales and Targeted Advertising

Depending on your location, you may have the right to opt out of the “sale” or “sharing” of your personal information or the disclosure of your personal information for purposes of online targeted advertising. We do not “sell” or “share” personal information in the traditional sense of exchanging information for monetary payment. We are committed to protecting your personal information and use a variety of technical, physical, and organizational security measures designed to protect against its unauthorized access, alteration, disclosure, or destruction. Although we will do our best to protect your personal information, we cannot guarantee the security of your data transmitted to our Services and therefore any transmission is at your own risk. Once we have received your personal information, we will use reasonable procedures and security features to try to prevent unauthorized access. We have put in place procedures to deal with any suspected personal information breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

The Services are not directed to individuals under 18 years of age and we do not knowingly collect personal information from individuals under 18 years of age. If we learn that we have collected any personal information from an individual under 18 years of age, we will take steps to delete such personal information.
